This Privacy Policy (“Privacy Policy” or “Policy”) explains how M.AI Unbound, Inc. (“M.AI Unbound,” or “we,” or “us,” or “our”) collects personal information based on your interactions with us online, including on our website, product dashboard and other integrated software and services (collectively, the Services). By accessing our Services and otherwise interacting with us, you agree to our collection, use and disclosure of your personal information as described in this Privacy Policy and in our Terms of Use.
Please note that this Privacy Policy does not cover personal information we collect or receive from our Merchants (as defined below) in connection with the services we provide in the ordinary course of business. Instead, we use such personal information received from Merchants to provide our usual services pursuant to a written contract and in accordance with our Merchants’ instructions. If you have any questions or concerns about one of our Merchants’ privacy practices, or the choices a Merchant has made to share your personal information with us, you should contact the Merchant directly. We are not responsible for the privacy or security practices of our Merchants, which may differ from those described in this Privacy Policy.
Personal Information We Collect – Sources and Types
When you interact with our Services, we collect your personal information when you visit or use our Services, create a user account, use our interactive tools or features on our Services, request information from us, register for our newsletter, place inquiries, comments, feedback or complaints, contact us via email or by phone, or otherwise interact with us through the Services.
We collect the following categories of personal information:
From Our Website Visitors (“Visitors”), including but not limited to our Business Customers (“Merchants”):
Personal identifiers: name, email address, phone number, IP address, any personal information contained in customer reviews, inquiries, complaints and on our product dashboard, including our AI chat feature, and usernames and passwords
Internet or other electronic activity information: your IP address, your device and browser type, your browsing and search history on our Services, and information regarding your interaction with our Services and our advertisements
Commercial and financial information: records of products or services ordered or considered, including subscription and other billing data such as refunds and/or chargebacks; other purchasing or consuming histories; and credit card or other payment information collected and processed via our third-party payment processor(s)
From Customers of Our Merchants (“Merchant Customers”):
We collect certain information from Merchant Customers who are browsing on the Merchants’ websites, such as Merchant Customers’ online interactions with the Merchants’ websites (e.g., pages clicked and time spent on the Merchants’ websites) and certain order data, including the order ID, monetary amount of orders, the kinds of products ordered, and the approximate location(s) of the individuals placing orders (e.g., zip codes and city/state). The information collected from Merchant Customers is strictly used to provide our services to Merchants pursuant to a written contract executed with our Merchants, and, when processed by us, does not identify any of the Merchant Customers.
How We Use Your Personal Information
We use your personal information to provide you with our Services and their contents to you, the information and services you requested from us, create and manage your user account to access our Services, process your order(s) and subscription(s), provide recommendations and customize our Services and your overall user experience, communicate with you from time to time, respond to your inquiries, comments, feedback and complaints, and provide customer support, required notices, technical or product updates, advertisements, marketing promotions and offers about our products or services we think may be of interest to you.
We also use your personal information about your use of our Services to monitor and improve our Services; for internal business analysis; to prevent fraud, activities that violate our Terms of Use or that are illegal; to comply with our legal obligations and other obligations arising from contracts entered into with our customers (e.g., to provide our analytics services to Merchants), and to protect our rights and the rights and safety of our users or others.
Disclosures of Your Personal Information
We disclose your personal information with service providers that help us operate our business, including through payment processing, verifying customer information, managing customer information, providing customer service, optimizing your overall user experience, facilitating email communications, providing security services and cloud-based data storage, hosting our Services and assistance with other IT-related functions, providing internal business analytics to improve our Services, advertising and marketing of our products, and providing legal and accounting services.
We also disclose your personal information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our or others’ rights, property, or safety, including to law enforcement agencies and judicial and regulatory authorities. We may disclose your personal information to third parties to help detect and protect against fraud or data security vulnerabilities. And, we may transfer your personal information to a third party in the event of an actual or proposed sale, merger, or reorganization of our entity or other corporate restructuring.
Retention of Your Personal Information
We will retain your personal information only for the length of time necessary to fulfill the purposes outlined in our Privacy Policy unless a longer retention period is required or permitted by law.
Our Use of Cookies and Analytics
We use cookies, pixel tags, web beacons and other similar tracking technologies (“tracking technologies”) to automatically collect information through our Services. Tracking technologies are small data files placed on your computer, tablet, mobile phone, or other devices that record certain pieces of information when you visit or use our Services. We use these tracking technologies to help identify irregular behavior, prevent fraudulent activity and improve security, as well as making it possible for you to save your preferences, help us understand how you interact with our Services, monitor and improve our Services, place marketing and other advertisements and provide you with a better user experience. We use certain tracking technologies to record your interactions with our Services and identify areas for improvement to optimize the user experience, including without limitation, your keystrokes, mouse clicks and scrolls, screen touches, and information about when, how and from where you accessed our Services.
To provide our services to our Merchants, we also use certain tracking technologies that are placed on Merchants’ websites to track Merchant Customers’ interactions with such websites to provide our services to our Merchants.
We use tracking technologies or otherwise collect personal information about your online activities over time and across different websites when you visit or use our Services.
You may set your browser to notify you when you receive a cookie. Many web browsers also allow you to block cookies. You can disable cookies from your computer system by following the instructions on your browser or at www.youradchoices.com.
We use Google Analytics to evaluate the use of our Services. Google Analytics uses cookies and other identifiers to collect information, such as how often users visit our Services, what pages they visit when they do so, and what other websites they visited prior to visiting our Services. Do Not Track Signals
Do Not Track (DNT) header signals allow users to tell certain websites not to track their online activities. Because there is no current industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
California Shine the Light
California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents that have an established business relationship with a business to annually request, free of charge, information about certain categories of Personal Information a business has disclosed to third parties for those parties’ direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their direct marketing purposes.
Marketing Communications
We use your personal information to send you marketing communications via e-mail about our Services, products and other services, and certain promotions or offers. If you do not want to receive future marketing communications via e-mail, you may opt-out of such communications by following the opt-out instructions included in the e-mail. Please note that you cannot opt out of transactional and administrative e-mails.
Limited Use of Google API User Data and Google Workspace APIs
We affirm that our Services do not retain or use any customer or other user data obtained through Google Workspace APIs, if any, to develop, improve or train generalized artificial intelligence (“AI”) or machine learning (“ML”) models.
Personal Information of Minors
Our products and services are not directed to minors under the age of 18 and we do not knowingly collect the personal information of minors under 18.
Securing Your Personal Information
We implement and maintain reasonable security appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process. However, there is no perfect security, and reasonable security is a process that involves risk management rather than risk elimination. While we are committed to maintaining a reasonable information security program, no such program can be perfect; in other words, all risk cannot reasonably be eliminated. Data security incidents and breaches can occur due to factors that cannot reasonably be prevented. Accordingly, it cannot be assumed that the occurrence of any given incident or breach results from our failure to implement and maintain reasonable security.
Other Third-Party Websites and Social Media Buttons
Our Services may contain links to third-party websites, including social media buttons that link to social media platforms. This Privacy Policy does not govern how those third parties or social media platforms collect or use personal information and we do not endorse or have control over their practices. The privacy policies and terms of use for those third-party websites or social media platforms govern those companies’ privacy practices. We are not responsible for the content or privacy practices of any third-party website or social media platform.
Changes to This Policy
We review and update this Privacy Policy from time to time. If changes are made, we will update the Privacy Policy and reflect the date of such modification in the Last Updated section above. If the changes are material, you will be notified via a notice on our website.
